PUBLIC PROSECUTOR The Court made the following: ORDER: ...RESPONDENT/COMPLAINANT The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.9 & 10 on bail in Crime No.22 of 2024 of A.Annavaram Police Station. Alluri Seetharama Raju District, registered against the Petitioners/Accused Nos.9 and 10 herein for the offences punishable under Section 8(c) read with Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’) '

2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. The petitioners/Accused Nos..9 and 10 are females and relatives of Accused No.1. Accused No.1 was found in possession of 54.200 grams of liquid ganja, which is not only a commercial quantity but also a huge quantity.
Accused No.1 gave a confession implicating all the accused, including the petitioners. The allegation against the petitioners/Accused Nos.9 and 10, as per the confession of Accused No.1, is that they had shifted three pots containing the contraband from one place to another. Accused Nos.6 and 7 are alleged to have been engaged for transportation of the contraband, while Accused No.2 is stated to have assisted Accused No.1 in dealing with the contraband. The learned Single Judge of this Court, in Crl.P.No.9061 of 2024 dated 20.12.2024, enlarged Accused No.2 on bail. Similarly, in Crl.P.No.7081 of 2024 dated 11.11.2024, and Crl.P.No.7981 of 2024 dated 02.12.2024
3. Accused Nos.6 and 7 were enlarged on bail. 4. Having regard to the gravity and nature of the allegations against the petitioners, when compared to those leveled against the other accused, the petitioners are facing milder accusations. The petitioners voluntarily surrendered on 13.08.2025 and have been in judicial custody for the past 77 days. They are permanent residents of Chintapalli Mandal, Alluri Seetarama Raju District. They have got fixed abode. So far, six witnesses have been
3 examined, all of whom are material and official witnesses. Therefore, the possibility of the petitioners threatening the official witnesses, tampering with evidence, or hampering the investigation does not arise. If appropriate conditions are imposed, there is no likelihood of their absconding or evading the process of law. By applying the principle of parity, the petitioners are entitled to be enlarged on bail. 5. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioners/Accused Nos.9 and 10 this Court is inclined to enlarge the Petitioners/Accused Nos.9 and 10 on bail. 6. In the result, the Criminal Petition is allowed with the following stringent conditions: The Petitioners/Accused Nos.9 and 10 shall be enlarged on bail subject to they executing bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two- sureties for the like sum each to the satisfaction of the learned Judicial First Class Magistrate, Chinthapalli. I. 1 ii.
The Petitioners/Accused Nos.9 and 10 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court. iii. The Petitioners/Accused Nos.9 and 10 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. 4 iv. The Petitioners/Accused Nos.9 and 10 shall not commit or indulge in commission of any offence in future. V. The Petitioners/Accused^ Nos.9 and 10 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. vi. The Petitioners/Accused Nos.9 and 10 shall surrender their passport, if any, to the investigating officer.
