Present petition has been filed challenging the impugned FIR dated 5.9.2024, registered as Case Crime No. 165 of 2024, under Sections 140(1), 309(6) BNS, P.S. Munderwa, District Basti. 3. On being confronted as to how present petition is maintainable as the petitioner is not named in the FIR, learned counsel for the petitioner prays that the petitioner may be permitted to withdraw the present petition with liberty to avail the remedy as may be available to him in law. 4. Prayer aforesaid is allowed. 5. Present petition is accordingly dismissed as withdrawn with liberty aforesaid.
