Sahay, A.P.P. ------ 03/ 20.11.2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner is apprehending his arrest in connection with Seraikella Mahila P.S. Case No. 13 of 2025, registered for the offences under Section 69 of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Seraikella. 3. Learned counsel appearing for the petitioner submits that the petitioner and the informant are major and allegations are made that on the pretext of marriage, the relationship was established. He submits that in the FIR itself, the relationship was alleged to be established three years prior to the lodging of the FIR and even the last alleged physical relation was established on 08.08.2025, but the FIR has been lodged on 03.09.2025. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that allegations are there to establish physical relation on the false pretext of marriage. 5. Looking in the contents of the FIR, it transpires that the [2025:JHHC:34603] -2- relationship was alleged to be established three years prior to the lodging of the FIR and even the last alleged physical relation was established on 08.08.2025, but the FIR has been lodged on 03.09.2025 and further the petitioner and the informant are major, I am inclined to provide the privilege of anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is hereby directed to surrender before the learned court within three weeks from today, and in the event of her surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Seraikella, in connection with Seraikella Mahila P.S. Case No. 13 of 2025, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated:-20.11.2025 Amitesh/-
