The learned counsel for the petitioner submits that the petitioner is the defendant in the suit and he filed written statement and the additional written statement during the course of the proceedings. Now the matter is coming up for trial and it is at the stage of defendant’s evidence. 3. The petitioner/defendant filed I.A.No.508 of 2024 in O.S.No.297 of 2017 on the file of Principal Civil Judge (Junior Division) cum Judicial Magistrate of I Class, Tirupati under Order 6 Rule 17 and 151 CPC r/w Section 28 of CRP specifically seeking grant of leave for withdrawal of some averments in the written statement of defendant, subject to costs. The said I.A. was dismissed vide order dated 28.10.2024, against which the present revision is filed. 4. The learned counsel for the petitioner submits that the defendant intends to withdraw the averments in Para No.6 of the written statement, for which, the above said I.A. was filed. 5. If the defendant does not want to adhere to the said averments he can report to the Court below also by not pressing those averments in the Para No.6 of the written statement filed already, by proceeding with the matter for trial as per law. 3 HBKM,J C.R.P.No.147 of 2025 6. With the above said observation, this Civil Revision Petition is disposed of. There shall be no order as to costs.
