The petitioner has been made accused in connection with Gomia P.S. Case No. 15 of 2024, corresponding to G.R. Case No.199 of 2024, for the offences registered under Sections 414/34 of I.P.C. and Section 30(ii) of the Coal Mines Act, pending in the court of Sri R. K. Pandey, learned JMFC, Bermo at Tenughat. On 27.02.2024, Gomia police on the basis of confidential information intercepted a truck bearing registration No. JH02BK-8131 and on search, 30 tons of illegal coal were found loaded on the said vehicle. It was submitted that the driver of the seized vehicle without consent and knowledge of the petitioner was transporting the seized coal. It was further submitted that the driver of the vehicle has been granted anticipatory bail by a Co-ordinate Bench of this Court. Mr. P. K. Chatterjee, learned Spl.P.P. has opposed the prayer for bail and submitted that petitioner is accused in as many as 9 cases. At this instance, learned counsel for the petitioner submitted that the petitioner has been acquitted in four cases. Considering the criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected at this stage. (Ambuj Nath, J.)
