JUSTICE C.M. POONACHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainants have filed the present complaint alleging wilful disobedience of an order dated 26.09.2024 passed by learned Single Judge of this Court in W.P.No.23395/2024 (GM-RES), whereby the accused was directed to initiate appropriate action in accordance with the representation dated 18.07.2024 filed by the complainants within a period of two weeks of receipt of the order. 2. The said order was passed in context with an earlier order dated 22.11.2023, whereby the accused was directed to recover the amount from Sashwati Reality Private Limited in terms of an order passed by the Karnataka Real Estate Regulatory Authority. - 4 - HC-KAR NC: 2025:KHC:42347-DB CCC No. 521 of 2025 3. The complainants alleged that the accused has not complied with the said order inasmuch as the accused has not taken any steps for recovering the amount as directed from the Sashwati Reality Private Limited as arrears of land revenue. 4. The learned Additional Government Advocate appearing for the accused has handed over a memo indicating that the steps for recovery have already been initiated and as a first step, a confiscation order dated 16.08.2025 is passed against the defaulter (Sashwati Reality Private Limited) with respect to its property described as Pashmina Brookwoods, Khata Nos.48, 49, 50 and 51 (old Sy. Nos.22,23/1 and 24), Kammasandra Village, Bidarahalli Hobli, East Taluk, Bengaluru. The said confiscation order also indicates that the process for selling the attached property for recovering the outstanding amount would be taken in accordance with law. 5. In the aforesaid circumstances, since respondent No.2 has already initiated steps for recovery of the amount due in compliance with the order, the present complaint is closed. - 5 - HC-KAR NC: 2025:KHC:42347-DB CCC No. 521 of 2025 6.
