Copy thereof has been supplied to learned counsel for the petitioner. 2. Arguments heard. 3. By way of present petition filed under Section 482 Bharatiya Nagarik Suraksha Sanhita, 2023, petitioner seeks anticipatory bail in case FIR (Annexure P-1) as under: FIR No. Dated Sections Police Station 18 31.01.2025 115(2), 118(1), 351, 3(5) of Bharatiya Nyaya Sanhita, 2023 Fatehgarh Sahib, District Fatehgarh Sahib SANDAL SHARMA 2025.04.10 16:57 I attest to the accuracy and authenticity of this order/judgment CRM-M-17122-2025 (O&M) -2- 4. It is inter alia contended by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case. He contends that no specific overt act is attributed to the petitioner. He submits that the petitioner is ready to join investigation and has prayed for grant of anticipatory bail to the petitioner. 5. Per contra, learned State counsel assisted by learned counsel for the complainant while referring to the status report filed by State has opposed the petition on the ground that there is specific attribution to the petitioner of having caused grievous injury on the person of the complainant, as such, the petitioner does not deserve the concession of bail and prayed for dismissal of the bail petition. 6. After considering the rival contentions and perusing the record, it is observed that the instant FIR was registered on the statement of the complainant alleging that on 30.12.2024, while he along with Karan Singh and Pala Singh were going to Village Madofal, then a Fortuner car hit their motorcycle from the side. Thereafter, three persons alighted from the car namely Harmanjot Singh (petitioner herein), Manpreet Singh @ Manna and Happy Dhillon. Thereafter, the complainant and his friends went to their village and at about 02:00 PM, when they reached near the house of Naib Singh, the aforesaid persons again hit their motorcycle with their Fortuner car, as a result of which they fell down. The assailants came out of the car and started beating them. The petitioner gave a stick blow on the head of complainant followed by Manpreet Singh @ Manna giving kirch blow on the abdomen, forehead, legs and head of the complainant. Happy Dhillon SANDAL SHARMA 2025.04.10 16:57 I attest to the accuracy and authenticity of this order/judgment CRM-M-17122-2025 (O&M) -3- gave blows on the face of the complainant. On raising alarm all the three assailants ran away from the spot. The injured was shifted to the hospital and the FIR was registered. Upon perusal of the record, it transpires that the petitioner has been specifically attributed stick blow on the head of the complainant and as per the MLR the injury was declared grievous in nature. The recovery of stick used in the commission of offence is yet to be effected from the petitioner. 7. Therefore, considering the nature and gravity of offence, it is observed that no case is made out in favour of the petitioner for grant of anticipatory bail, as a consequence, the petition is hereby dismissed. 8. Any observation made above shall not be construed as opinion of this Court on the merits of the case. (SANJIV BERRY) JUDGE 09.04.2025 S.Sharma(syr) i) Whether speaking/reasoned?
