Ms. Debjani Ghosal …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the respondent no. 1 in Misc. Appeal No. 63 of 2022 praying for a direction upon the learned District Judge, Hooghly to dispose of the misc. appeal expeditiously. Learned advocate appearing for the petitioner submits that the appellant in the misc. appeal is deliberately avoiding to take steps for service upon the respondent nos. 2, 3, 4, 5 and 6. She submits that they are trying to delay the hearing of the misc. appeal. She further submits that in violation of an order of status quo the opposite parties are making construction. From the order-sheets appended to this application this court finds that by an order dated June 9, 2025, the appellant was directed to take steps for service upon the respondent nos. 2, 3, 4, 5 and 6 and the appellant had also filed the requisites for issuance of summons upon the respondents for both ways. It further appears that the misc. appeal is not ready for hearing. For such reason this court is not inclined to pass any order for expeditious hearing at this stage. It will be open to the petitioner to take appropriate steps in the misc. appeal. With the above observations, CO 3386 of 2025 stands disposed of. (Hiranmay Bhattacharyya, J.) 2
