The Court made the following: :: ORDER :: The above contempt case has been filed complaining about the non- implementation of the order dated 27.02.2024 passed in W.P.No.24395 of 2023. 2. Heard learned counsel appearing on either side. 3. The petitioners filed W.P.No.24395 of 2023, to declare the action of respondent authorities in not evicting the encroachers even after identifying the encroachments made on 60 feet public road on the Eastern side of the petitioners’ property and after issuance of eviction notices, as illegal and arbitrary. 4. The aforementioned writ petition was disposed of 27.02.2024, directing the Commissioner, Gudivada Municipality, to initiate necessary action, strictly in accordance with law, pursuant to the notice dated 07.03.2023, if no interim order is passed by the Civil Court in O.S.No.62 of 2023, on the file of the learned Principle Junior Civil Judge, Gudivada. 5. A counter-affidavit has been filed by respondent No.3. Along with the counter-affidavit, an injunction order granted in I.A.No.345 of 2023 in O.S.No.67 of 2023 on the file of the learned Principle Junior Civil Judge, Gudivada has been annexed. 6. As seen from the aforementioned injunction order, the learned Principle Junior Civil Judge has granted temporary injunction on 15.03.2023 and the order of injunction has been extended from time to time. 7. Since the competent Civil Court granted temporary injunction, this Court does not find any violation of the order dated 27.02.2024 passed in W.P.No.24395 of 2023. Hence, this Court does not find any merit in the contempt case and the same is liable to be dismissed. 8. Given the facts and circumstances of the case, the Contempt Case is dismissed. No order as to costs.
