...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue writ order or direction more particularly one in the nature of Writ of Mandamus under Article 226 of the constitution of India by declaring the action of Respondents No. 3 and 4 in not disposing the complaint of the petitioner dt. 09.09.2024 in accordance with law, without doing any investigation or giving any opportunity to submit evidence and failed to register FIR despite the receipt of the said complaint nor taken any action

against the accused mentioned in the complaint as illegal, arbitrary and violative of Article 14,19 and 21 of Constitution of India and also in contravention of Apex Court Judgment in Lalita Kumari V. Government of U.P., and consequently direct the Respondent Police to register the complaint of the petitioner and take appropriate action in the matter in accordance with law IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents to register the complaint dt. 09.09.2024 forthwith Counsel for the Petitioner:

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue writ order or direction more particularly one in the nature of Writ of Mandamus under Article 226 of the constitution of India by declaring the action of Respondents Nos. 3 and 4 in not disposing the complaint of the petitioner dt.09.09.2024 in accordance with law, without doing any investigation or giving any opportunity to submit evidence and failed to register FIR despite the receipt of the said complaint nor taken any action against the accused mentioned in the complaint as illegal, arbitrary and violative of Article 14,19 and 21 of Constitution of India and also in contravention of Apex Court
Judgment in Lalita Kumari V. Government of U.P., and consequently direct the Respondent Police to register the complaint of the petitioner and take appropriate action in the matter in accordance with law..…”
2. Heard Sri Bugulu Sreeteja, learned Counsel for the Petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for the Official Respondents.
3. Learned Assistant Government Pleader for Home, on written instructions, would submit that a case has been registered against the Petitioner in Cr.No.649 of 2024 under Sections 351(2), 79 r/w 3(5) of BNS, of Nallapadu P.S., on 06.09.2024. He would further submit that only to overcome the said case, the present complaint has been submitted to the Police. The Police have not registered any crime basing on the complaint of the Petitioner, since it turned out to be a false one.

4. Recording the same, this Writ Petition is disposed of. However, the Petitioner is at liberty to work out her remedies before the appropriate forum according to law. There shall be no order as to costs.
