The Court made the following Order:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…issue a Writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent herein in issuing proceedings in File No.Rev-CSEC 0 AA (REN) 136/2020-SA (C3) KDPCO dated 30-05-2021 refusing to renew the weapon licence in respect of .32 revolver bearing weapon licence No. Kadapa 385 and also not passing any order in respect of disposal of weapon in view of the refusal of renewal of weapon licence as arbitrary, illegal and against principles of natural justice and for a consequential direction to pass appropriate orders in respect of disposal of .32 revolver with licence No. Kadapa 385 by the petitioner as per law which is in safe custody of 4th respondent and to pass”. 2. Heard Sri M.V.Pratap Reddy, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioners would submit that the petitioner has made a request before the authorities for renewal of the license of the weapon in respect of .32 revolver. Learned counsel would further submit that the Collector and District Magistrate, Kadapa, YSR District vide order No.Rev-CSEC ) AA (REN) 136/2020-SA (C3) KDPCO dated 30.05.2021 informed that there is no imminent reason to renew the arms license and there is no specific threat to life of the applicant and therefore, the application for renewal of Arms License is rejected. 4.
Learned Assistant Government Pleader for Home would submit that concerned authority has rightly passed the order and not recommended for renewal of the licence as there is no threat is perceived. 4. In that view, the writ petition is disposed of. However, the respondent No.2 is directed to look into the matter and pass orders afresh regarding the request of the petitioner for disposal of the weapon within two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs.
