This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.98/2025 registered at Police Station GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.08.18 14:40:33 +0530

Case of the prosecution, in brief, is that complainant Laxminarayan Prajapati lodged report and alleged that applicant used to harass his daughter as she talked in mobile phone and also beaten her and during investigation it revealed that applicant also married with another girl and kept her as his second wife and to deceased who was legally wedded wife of applicant not providing the expenditure for household things and due to that deceased committed suicide by hanging herself, on the report offence u/s 108 of B.N.S, has been registered against the present applicant and the applicant has been arrested and he is in jail since18.05.2025.

Learned counsel for the applicant submitted that the applicant is the husband of the deceased and the marriage between the two was solemnized in the year 2014 and from the wedlock three children have been born. It is argued that because of some household dispute a quarrel took place and the deceased committed suicide by hanging herself in the house and the cause of death is asphyxia due to antemortem hanging. He would submit that the applicant is in jail since 18/05/2025, charge sheet has been filed and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel had opposed the prayer
3 for grant of bail and submitted that though there was some house hold dispute between the applicant and his wife but the daughter and mother of the applicant have stated in their statement under Section 180 BNS that the applicant had in the night had slapped his wife and had assaulted her on account of which there was facial swelling was seen, and an abrasion was also seen over the right elbow (2x3 cm), as well as swelling over the occipital region of the head, and ligature marks were present which goes to show that the applicant was instrumental and had abetted his wife to commit suicide, therefore applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, considering the fact that though there was some house hold dispute between the applicant and his wife but the daughter and mother of the applicant have stated in their statement under Section 180 BNS that the applicant had in the night had slapped his wife and had assaulted her on account of which there was facial swelling was seen, and an abrasion was also seen over the right elbow (2x3 cm), as well as swelling over the occipital region of the head, and ligature marks were present which goes to show that the applicant was instrumental and had abetted his wife to commit suicide therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 4

Accordingly, the bail application of applicant Sukhnandan Prajapati- involved in Crime No.98/2025 registered at Police Station Basantpur, District Balrampur- Ramanujganj, C.G. for the offence punishable under Section 108 of B.N.S., is rejected. 8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information. - Sd/-
