JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused Nos.1 and 2 under Section 482 of BNSS praying to grant anticipatory bail in Crime No.342/2025 of Chikkamangaluru Rural Police Station registered for offences under Sections 115(2), 118(1), 190, 109 of BNS. 2. Heard learned counsel for the petitioner and learned Additional SPP for the respondent -State. 3. Learned counsel for the petitioner would contend that the quarrel took place for trivial issue of touching of the vehicle. The complainant has stated in his complaint that due to night, he could not identify, 5 to 6 persons who assaulted him. The averments of the complaint indicate that - 3 - HC-KAR NC: 2025:KHC:52561 CRL.P No. 15408 of 2025 Nagaraju, Shekhar and Kumar have taken the injured to the hospital. But, MLC intimation indicates that injured has been brought by Ramesh - the brother of the injured. The petitioners are ready to abide by any conditions to be imposed by this Court. With this, he prays to allow the petition. 4. Per contra, learned Additional SPP for the respondent –State would contend that the injured has sustained eight injuries and all are grievous injuries. The assault is on the head of the injured, which is vital part. The investigation is in progress. Considering the said aspect, the petitioners are not entitled for grant of anticipatory bail. With these, she prays to reject the petition. 5. Having heard learned counsels, the Court has perused the FIR, complaint and other materials placed on record. 6. The injured has filed complaint on 16.10.2025 when he was in hospital. Based on that, a case has been registered against the petitioners and others for aforesaid - 4 - HC-KAR NC: 2025:KHC:52561 CRL.P No. 15408 of 2025 offences. The names of petitioners have been specifically stated in the averments of the complaint. Petitioner Nos.1 and 2, and other 5-6 persons have assaulted the complainant with chopper on his head 3 to 4 times. The assault is with deadly weapon on the vital part i.e., head. The wound certificate indicates that the injured sustained 08 grievous injuries. The investigation is in progress. Considering the same, the petitioners are not entitled for grant of discretionary relief of anticipatory bail. In the result, the petition is dismissed.
