ORAL ORDER
This petition is filed assailing the concurrent finding in a proceeding under section 138 of Negotiable Instruments Act.
2. That the petitioner/accused convicted to pay a fine of Rs.8,00,000/- in connection with the dishonour of cheque for Rs.4,00,000/-. The appeal filed by the petitioner/accused is also dismissed. A joint memo is filed reporting settlement.
3. Joint memo is taken on record.
4. Joint memo is signed by the counsel for the petitioner and counsel for the respondent.
5. It is stated that the petitioner/accused has paid Rs.5,00,000/- to the complainant/respondent towards discharge of full and final claim of the complainant/respondent.

6. After going through the joint memo, this Court does not find any impediment to accept the terms of the settlement. The impugned judgments passed by the Trial Court and the Appellate Court are set-aside.
7. The petitioner is acquitted and bail bond stands cancelled.
8. Amount in deposit if any made by the petitioner shall be released to the petitioner/accused.
