JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is seeking to enlarge him on anticipatory bail in connection with a case registered in Crime No.84/2024 of Bantwala Town Police Station, Dakshina Kannada, for the offence punishable under Section 489B, 489C r/w 34 of IPC. 2. Heard the learned counsel for petitioner, learned High Court Government Pleader for the State and perused the material on record. 3. FIR is registered on a complaint lodged by the PSI (L & O), Bantwala Town Police Station, on the basis of which crime is registered against accused Nos.1 to 3. - 3 - HC-KAR NC: 2025:KHC:37197 CRL.P No. 12184 of 2025 4. It is alleged that accused Nos.1 and 2 were found in possession of counterfeit currency notes and the police apprehended them and recovered counterfeit currency notes of Rs.500 denomination from them, whereas accused No.3 managed to escape. 5. Name of the petitioner is not in the FIR. In the chargesheet, he has been arraigned as accused No.4. It appears that petitioner has been arraigned as an accused in this case on the voluntary statement of the co-accused. No criminal antecedents against the petitioner are brought to the notice of the Court. It is not in dispute that accused Nos.1 to 3 are enlarged on bail. Hence, by imposing necessary conditions, relief sought in the petition can be granted. Accordingly, the following: ORDER (i) Petition is allowed. (ii) Petitioner/accused No.4 (as per chargesheet) shall be released in the event of his arrest in Crime - 4 - HC-KAR NC: 2025:KHC:37197 CRL.P No. 12184 of 2025 No.84/2024 of Bantwala Town Police Station, Dakshina Kannada, registered for the offence punishable under Section 489B, 489C r/w 34 of IPC, subject to following conditions. a) He shall appear before the Investigation Officer within one week from the date of receipt of a copy of the order and shall execute a bond in a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum. b) He shall cooperate with the further investigation of the case, if any and shall be available for investigation whenever necessary. c) He shall furnish his residential address/contact number and shall inform the I.O in case of any change in the address/contact number. c) He shall not tamper with the prosecution evidence/witnesses either directly or indirectly. - 5 - HC-KAR NC: 2025:KHC:37197 CRL.P No. 12184 of 2025 d) He shall appear before the Court on every date of hearing, without fail. e) He shall not indulge in committing any offence.
