Order Reserved on 28/10/2025 Pronounced on 11 /11/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 09/2023 registered at Police Station Cyber District Tonk for the offence(s) under Sections 384, 419, 420 of IPC and Section 66C & 66D of IT Act, 2008.
2.
Learned counsel for the accused–applicant had submitted that the applicant is 23 years of age and has no criminal
[2025:RJ-JP:44918] (2 of 3) [CRLMB-12269/2025] antecedents to his discredit. It was further submitted that the FIR in the present case was lodged by the police authorities and not by any victim or complainant and that the applicant has been in judicial custody since 19.08.2025. Learned counsel further submits that the applicant is ready and willing to abide by all conditions that may be imposed by this Court.
3. Per contra, learned Amicus Curiae, learned Government Advocate-cum-AAG Mr. Rajesh Choudhary, and the concerned Officer appearing through Video Conferencing have stoutly opposed the bail application. Considering that the matter pertains to cyber crime, apart from the general submissions made and as forming part and parcel of S.B. Criminal Miscellaneous Bail Application No. 9343/2025, it was specifically submitted that the applicant was absconding prior to his arrest, though the FIR had been lodged in the year 2023.
4. It was further submitted that a reward of ₹5,000/- had been announced for tracing the applicant. The applicant was subsequently produced on a production warrant, as there exists one antecedent being FIR No. 246/2025 registered at Mathura. It is further contended that the applicant destroyed his mobile phone as well as the SIM card, resulting in non-recovery of those articles.
5. It was also analyzed during the investigation that the applicant admitted to having made a video call to the victim, during which a nude lady was displayed, impersonating herself as a police authority, thereby inducing the victim to believe that he was involved in an illicit act. Thereafter, money was extorted from the victim. The investigation further revealed that multiple cyber
[2025:RJ-JP:44918] (3 of 3) [CRLMB-12269/2025] complaints are registered against the applicant in various States, including Punjab, Uttar Pradesh, and Maharashtra, involving the use of different identity numbers and mobile connections. A recovery of ₹1.26 lakh has also been effected in the matter.
6. In view of the aforesaid facts and circumstances, and upon
consideration of the material available on record, and taking note of the submissions made by the learned counsel representing the State, the fact that there is a reward against the name of the applicant; that the applicant has made an act of tampering the evidences; that investigation further revealed that multiple cyber complaints are registered against the applicant in various States, including Punjab, Uttar Pradesh, and Maharashtra, involving the use of different identity numbers and mobile connections but without commenting upon the merits or demerits of the case, this Court is not inclined to grant the relief of bail to the accused– applicant at this stage.
7. Accordingly, in light of the general observations recorded in S.B. Criminal Miscellaneous Bail Application No. 9343/2025, the ratio passed in Re: Victims of Digital Arrest Related to forged Documents: [Suo moto writ petition (criminal) No. 3/2025], the instant bail application filed under Section 483 of the BNSS stands dismissed at this stage.
