JUSTICE ASHOK KUMAR JAIN
Order 12/06/2025
1. The instant fifth bail application is preferred by the petitioner accused-Pulkit Yadav in a matter arsing out of FIR No.531/2024 Police Station-Jhotwara District Jaipur(West) wherein last bail application by Learned Additional Sessions Judge No.3, Jaipur Metropolitan-II was dismissed on 19.05.2025.
2.
Learned counsel for the petitioner submitted that the parties have settled their dispute and said compromise filed on record and attested on 22.05.2025. He also submitted that on 10.05.2025, the father of this petitioner has expired and this petitioner was granted interim bail from 13.05.2025 to 26.05.2025. He also submitted that after death of his father, his mother is falling ill and
[2025:RJ-JP:23158] (2 of 3) [CRLMB-7390/2025] he is the only son to take care of his ill mother. He further submitted that for other offences which are not compoundable, the trial will take its own time. 3. Aforesaid contentions were opposed by learned Public Prosecutor but learned counsel for the complainant has supported the case of counsel for the petitioner accused. 4. Heard, learned counsel for the parties and learned Public Prosecutor. Perused the material available on record. 5. The first bail application of this petitioner was dismissed on 10.12.2024 whereas second bail application was dismissed on 24.01.2025 and third bail application on 01.04.2025, this petitioner was granted interim bail on 13.05.2025 by a Coordinate Bench. 6. A perusal of record indicates that after dismissal of bail application on 01.04.2025, this petitioner has filed another bail before learned trial court and same was dismissed on 19.05.2025, only thereafter he has filed a compromise with complainant on
22.05.2025. After compromise by this petitioner, instead of filing a bail before learned Additional Sessions Judge, petitioner has directly approached this court. It appears that the petitioner is desperate to seek bail as in less than period of two months, he has filed three successive bail application and out of which one was dismissed, one interim was granted and third one is before this court. 7. Except compoundable charges under Sections 351(2)(3),127(2) and 115(2) of BNS, still other charges under Section 310(2), 331(4),140(3) & 61(2) of BNS remained for trial. In order dated 10.12.2024 we have noticed that three other criminal cases were
[2025:RJ-JP:23158] (3 of 3) [CRLMB-7390/2025] registered against petitioner-Pulkit Yadav. Learned counsel has failed to show current status of these cases which were registered in year 2019, 2020 & 2023. 8. Having considered the fact, that this petitioner is main accused in the instant case and he is having a criminal background, therefore, looking to gravity of charges and chances of repetition of criminal activities, he is not entitled to be released on bail. 9.
Therefore, the present fifth bail application is hereby dismissed. (ASHOK KUMAR JAIN),J Anu /S-1
