HON'BLE MR. JUSTICE VINOD KUMAR BHARWANI Order 19/12/2025 The instant bail applications have been filed under Section 483 B.N.S.S. on behalf of accused-petitioners in the matter arising out of F.I.R. No.606/2025, registered at Police Station Kotwali Jhalawar, District Jhalawar for the offence(s) punishable under Section(s) 111(3), 111(4), 111(5), 111(6), 318(4), 316(2), 338, 336(3), 340(2) & 308(6) of B.N.S. Learned counsel for the petitioners submit that the petitioners have been falsely implicated in the case, they have nothing to do with the alleged offence(s) and they are behind the bars since 31.10.2025 & 30.09.2025. Counsel further submits that among all the petitioners, two are women and the other co- accused persons have already been granted bail by this Court. Trial/investigation of the case is likely to take a long time to conclude, till then, their further incarceration would not serve any fruitful purpose and they are ready and willing to furnish their bail bonds. Therefore, the bail applications deserve to be allowed. [2025:RJ-JP:51426] (3 of 3) [CRLMB-16045/2025] Learned Public Prosecutor has vehemently opposed the bail applications. Heard learned counsel for the parties and perused the material made available on record. Taking into consideration the submissions put forth, custody period, evidence adduced during investigation, two of the petitioners are women among all the petitioners and overall facts & circumstances of the case but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused-petitioners on bail. Therefore, the bail applications are allowed. Accused- petitioners, namely Jyoti Alias Janhvi S/o Shri Ramlal, Seema D/o Biram, Riyaz S/o Abdul Razzaq & Yogendra Singh S/o Late Shri Suryabhan Singh, shall be released on bail, if they are not required in any other case, provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Fifty Thousand) together with two sureties in the sum of Rs.25,000/- (Twenty-five Thousand) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when they are called upon to do so.
