Petitioner complains that Ultadanga PS Case No. 182 dated 15.12.2023 has been registered for investigation at his behest. However, the police authorities without collecting the documents and/or carrying out proper investigation, immediately after the writ petition was preferred before this Court, submitted Final Report/FRT with their opinion, as ‘civil in nature’. Learned advocate for the private respondents are present.
2 Since the report of the State reflects that the final report has been submitted. Petitioner be well advised to prefer an application under section 173(8) Cr.P.C. If such an application is filed, learned Magistrate would within a period of 45 days from filing of the application dispose of the same. Learned Magistrate would asses and ascertain the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper. With the aforesaid observations WPA 21648 of 2025 is disposed of. Report submitted be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
