Agreement No. 19/2021-2022 entered with petitioner 4th respondent under State Development Project (SDP), even after finalizing the bills as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India and also oppose to the settled principles of law, and consequently direct the respondents to forthwith release total amount of Rs.12,98,569/- payable to the petitioner for the execution of work vide Agreement No. 19/2021-2022 entered with 4th respondent under State Development Project (SDP) and pass IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to release the amount Rs.12,98,569/- and pay the same to petitioner for the execution of work vide Agreement No. 19/2021-2022 entered with 4th respondent under State Development Project (SDP)pending disposal of the writ petition and pass such Counsel for the Petitioner:

The Court made the following order: The grievance of the petitioner is that despite finalization of the bills, the respondent authorities are not releasing the amount of Rs.12,98,569/- in relation to execution of work vide Agreement No.19/2021-22 under State Development Project (SDP). 2.
When the matter is taken up for consideration today, Smt D.Chandrika, learned Assistant Government Pleader for Panchayat Raj & Rural Development, placed on record the written instructions of the Executive Engineer, PR (PIU) Division, Puttaparthi, dated 30.11.2025 and submitted that the bill of the petitioner is submitted on 18.11.2025 for a gross amount of Rs.12,98,569/- and the net bill amount is Rs.10,70,499/- and the bill is approved on 26.11.2025 in PAO, Anmanthapuramu vide CFMS (Sap) bill No.2025-1933533 and is pending for payment, however sought three months’ time for payment of the said amount. 3. To the said submission, Sri L.Sai Manoj Reddy, learned counsel for the petitioner, reported no objection regarding the said amount and the request for three months’ time for payment of the said amount and prayed to pass appropriate orders in that regard. 4. In view of the facts and circumstances of the case and taking the submissions of learned counsel for the parties into consideration, as the authorities have expressed their intention to pay the entitled amount to the petitioner, there is no purpose in keeping this Writ Petition pending. As such,

this Court is inclined to dispose of the same, with the consent of both the parties, at the admission stage itself, by passing the following order:
“The respondent authorities are directed to pay an amount of Rs.10,70,499/- (Rupees Ten Lakhs Seventy Thousand Four Hundred and Ninety Nine only) to the petitioner within a period of three (3) months from the date of receipt of a copy of this order. It would be open to the petitioner to agitate his claim for interest, if any, payable by the respondents in an appropriate forum, if so advised.”
5. Accordingly, the Writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, interlocutory applications pending, if any in the Writ Petition, shall also stand closed.
