[2025:RJ-JP:4460] (1 of 3) [CRLMB-919/2025] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 919/2025 Harilal @ Hariram Kumawat S/o Late Shri Bhuraram Kumawat, Aged About 47 Years, R/o Village Sawai Jaisinghpura, P.s. Bagru, District Jaipur (At Present Confined In Central Jail Ajmer). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Devanshu Sharma with Ms. V. Pareek For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 31/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 04/2025 registered at Police Station Gandhi Nagar, District Ajmer for offences under Section 318(4), 316(2), 123 & 61(2) (a) of BNS. It is contended by counsel for the petitioner that petitioner has been falsely been implicated in this case. Counsel further submits that the main allegation of cheating with the complainant and entering into marriage with the complainant is against the other co-accused Sudha Singh. Petitioner was only a mediator in solemnizing the marriage of the complainant and Sudha Singh and petitioner was not aware that Sudha Singh will fled away along with gold articles of the complainant. It is further submitted that offences alleged to have been committed by the petitioner are triable by Magistrate, accused-petitioner is in custody since [2025:RJ-JP:4460] (2 of 3) [CRLMB-919/2025] 08.01.2025 and trial of the case will take considerable time. There are no criminal antecedents against the petitioner, therefore, the petitioner may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail application and submitted the factual report which shows that petitioner was acting as mediator in solemnizing the marriage of other co-accused- Sudha Singh with the complainant. Sudha Singh after entering into the marriage fled away from her marital house along with the jewellery. Heard and perused the material available on the record. Considering the period of incarceration and the fact that there are no criminal antecedents of the petitioner, trial of the case will take considerable time, furthermore case of the petitioner is triable by Magistrate and petitioner is a resident of Bagru (Rajasthan), swithout expressing anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Harilal @ Hariram Kumawat S/o Late Shri Bhuraram Kumawat, in connection with FIR No. 04/2025 registered at Police Station Gandhi Nagar, District Ajmer shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the date of hearing and as and when called upon to do so.
