HC-KAR NC: 2025:KHC:33066 WP No. 25033 of 2025
CORAM: HON'BLE MR. JUSTICE M.I.ARUN
ORAL ORDER The petitioner has been permitted to put up a hoarding on his property and carry on the business of advertisement. It is the case of the petitioner that respondent no.6 is also permitted to put up an advertisement hoarding two buildings after the property of the petitioner and the said hoarding blocks the view of the hoarding of the petitioner. This according to the petitioner is against the law. Hence, he has made a request to respondent no.3 in this regard who has asked respondent no.4 to consider the request of the petitioner and submit a report. It is submitted that inspite of it, no action has been taken. Hence, the present writ petition is filed with the following prayers:
"(a) Issue a writ in the nature of certiorari, quashing the impugned permission/order bearing no.SA.KAM.A(CHA-PO)/P.R/57/2025-26 dated 16.07.2025 issued by the Respondent no.5 at Annexure-C,

HC-KAR NC: 2025:KHC:33066 WP No. 25033 of 2025
(b) Issue any other writ, order or direction which this Hon'ble Court may deem necessary in the circumstances of the case, in the interest of justice and equity."
2.
Learned counsel for respondent nos.2 to 6 together upon instructions submit that permission granted in favour of respondent no.6 has been done in accordance with law and not otherwise. However, they are not in a position to rebut the fact that respondent no.3 has
directed respondent no.4 to submit a report.
3. Under the present circumstances, I am of the opinion that the interest of justice would be met if respondent no.3 is directed to conduct the necessary enquiry and take appropriate decision on the representation made by the petitioner after hearing both the petitioner and respondent no.6 in this regard. Hence, the following:
- 5 -
HC-KAR NC: 2025:KHC:33066 WP No. 25033 of 2025
ORDER i) Respondent no.3 is directed to conduct necessary enquiry on the representation of the petitioner. Hear both the petitioner and respondent no.6 and thereafter, pass an appropriate order in accordance with law but not later than 30 days from the date of receipt of certified copy of this order;
ii) The writ petition is disposed of accordingly.
