Learned counsel for the petitioner submits that the alleged offence is triable by the Magistrate and the petitioner was arrested on 13.06.2025 and after investigation, charge-sheet has been filed. Counsel submits that the benefit of bail has already been granted to the co-accused person, namely, Digendra @ Dabbu by the Co-ordinate Bench of this Court while deciding S.B. Criminal Misc. Bail Application No.10355/2025 and since the trial will take its own time to conclude, therefore indulgence of bail be granted to the petitioner. 3. Per contra, learned Public Prosecutor opposed the prayer and submitted that four other criminal cases of similar nature are (2 of 2) [CRLMB-12043/2025] pending against the petitioner, hence, he is not entitled to get the benefit of bail. 4. Heard and considered the submissions made at the Bar and perused the material available on record. 5. Considering the arguments put forward by the learned counsel for the petitioner and looking to the fact that the alleged offence is triable by the Magistrate and benefit of bail has already been extended to the co-accused Digendra @ Dabbu and the petitioner is in custody since 13.06.2025 and the trial will take its own time to conclude, without expressing any opinion on merits and demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the petitioners under Section 483 BNSS. 6. Accordingly, this bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Devendra S/o Gyansingh @ Chhanga arrested in connection with aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing, as and when called upon to do so. 7. In case, the petitioner is found involved in committing and repeating the same offence again in future, the Public Prosecutor/State would be at liberty to move an application for cancellation of their bail before the Jurisdictional Court.
