1. This writ petition has been preferred under Article 226 of the Constitution of India seeking following reliefs:
“10.1 That the Hon'ble Court may kindly be pleased to quash the impugned Directive Letter dated 04/07/2025 (Ann. P-5) and the Show Cause Notice dated 30/07/2025 (Ann. P-7) both issued by Respondent No.3. 10.2 That the Hon'ble Court may kindly be pleased to direct the Respondent No.2, the Commissioner, to forthwith entertain and decide the appeal of the Petitioners on its merits in a time-bound manner. 10.3 That the Hon'ble Court may kindly be pleased to direct the respondents to maintain the status quo regarding the employment of Shri Netram Sahu (Respondent No.6) until the final disposal of the disciplinary proceedings and the criminal case against him. 10.4 That the Hon'ble Court may kindly be pleased to grant any other order or direction that this Hon'ble Court may deem fit and proper in the interest of justice.”
2.
Learned counsel for the petitioners -Samithi contended that on 05.06.2025, a letter was received by the petitioners -Samithi from respondent No.3/Assistant Commissioner, which mentioned the application given by respondent no.6 to the Hon'ble Chief Minister Chhattisgarh Government regarding getting legal justice. The said letter was replied by the Samiti on 30.06.2025 and requested that respondent No.6 is of criminal nature, hence, his application
3 should be rejected and disposed of. When the Samiti resisted, the Assistant Commissioner issued a show cause notice dated 30.07.2025 threatening to remove the Samiti's management. Thereafter, a statutory appeal was filed against the impugned letter and show cause notice before the Commissioner/respondent No.2, but he deliberately refused to entertain the same, hence, the petitioners have come-up before this Court with aforesaid prayer. 3. Learned State Counsel submits that respondent-authority has not taken any punitive action or passed any order against him, hence, writ petition deserves to be dismissed. 4. Heard learned counsel for the parties. 5. Relevant portion of order dated 04.04.2024 (Annexure P-1) passed by the Joint Registrar, Co-operative Societies, Bilaspur reads as under:
