Order on Board 14.08.2025
1. This is an office reference.
2. This Court, vide order dated 05.02.2025, passed in MCRC No. 138 of 2025, while allowing the bail to the applicants, namely, Ankit Yadav and Prem Sahu, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 certified copy of the order, if there was no legal impediment.
3. The learned Special Judge (NDPS Act), Raigarh, District – Raigarh (C.G.) vide his request letter dated 01.08.2025 has requested for grant of four months time for concluding the trial.
4. It transpires from perusal of the PUD that the case is currently at the stage of prosecution evidence. Out of 16 prosecution witnesses, only 04 witnesses have been examined so far. As the witnesses belong to another district and despite issuing summons/warrants multiple times they have not appeared, the case could not be disposed of within the stipulated time. A memorandum is being issued to ensure that the summons/warrants to the witnesses are executed through the Superintendent of Police on a priority basis and there is a strong likelihood that the case will be concluded within 04 months. Therefore, further period of 04 months is required for the disposal of the case.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of four months from today.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
