At the outset, learned counsel for the petitioner would submit that order under contempt was put to challenge by the State before the learned Division Bench bearing Writ Appeal No.734/2024 and the appeal has been allowed by learned Division Bench vide order dated 12.12.2024 and order under contempt dated 28.8.2024 (Annexure-C/1) passed by 2 the Single Judge in WPC No.3459/2024 and other connected matters has been set aside, therefore, he submitted that this contempt petition has become infructuous. 2. Learned State counsel also conceded aforesaid contention. 3. As contended by learned counsel for both the parties, since order under contempt is set aside by learned Division Bench, therefore, no case of contempt of the impugned order is made out, as such, this contempt petition is dismissed.
