ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... Writ of Mandamus declaring the action of respondents in freezing the petitioner's bank account vide bearing No. 4802135000006251 with the 3rd respondent without issuing any notice and without following any due procedure established under law as being illegal, arbitrary, dehors jurisdiction and opposed to very spirit and nature of Article of 14, 19(1)(g) and 21 of the Constitution of India besides being opposed to BNSS Act and RBI guidelines and violative of principles of natural justice and consequently direct the respondents to enable the petitioner to operate the said bank account by de-freezing the same.”
2. Sri Kaushik Kumbhajadala, learned counsel for the Petitioner would submit that, no crime is registered against the Petitioner. Learned counsel would further submit that one Naveen Chowdary purchased gold from the Petitioner and transferred an amount of Rs.10,50,000/- through RTGS to the Petitioner’s account. Learned counsel would further submit that, the bank account of the Petitioner was freezed due to which he is unable to do day-to- day business transactions. 3.
Sri V.Farooq, learned Assistant Government Pleader for Home representing Tamilnadu Police placed the FIR in Crime No.256 of 2025 of K.K.Nagar Police Station, T.Nagar, on record and would submit that the disputed amount in this matter is Rs.14,50,000/-. It is further submitted that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of. Respondent – Bank is directed to defreeze the bank account bearing No. 4802135000006251 of the Petitioner subject to the condition that the Petitioner shall maintain minimum amount of Rs.14,50,000/- therein. With

regard to the disputed amount of Rs.14,50,000/-, the Petitioner is at liberty to work out their remedy before appropriate forum. There shall be no order as to costs.
