The present applicant ‘Baba Malredy Naveen Redy’ is praying for regular bail in relation to Session Trial No. 03 of 2023 arising out of a First Information Report dated 01.08.2023 bearing FIR No. 0005 of 2023 P.S. Badrinath, District Chamoli, wherein, the present applicant is facing the trial for the offences punishable under Section 302 r/w Section 201 of IPC.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and has no previous criminal history and is languishing in jail since 01.08.2023.

He further submits that the chargesheet has already been filed therefore there is no need of custodial interrogation and in total 9 witnesses have been examined uptill date and 4 witnesses are still remain to be examined and out of 9 witnesses who were examined one of the witness i.e. PW7 Swami Yoganand has been declared hostile.
6. He submits that the applicant is a Sanyasi, who comes to Badrinath Dham for meditation.
7. On the other side, Mr. V.S. Pal, learned A.G.A. submits that the offence is very serious and the trial is still going on and on pointing out of the present applicant the hammer was recovered, which was used for killing the deceased.
8. After hearing the arguments of learned counsel for the parties and further after gone through the FIR and the grounds as taken in the bail application, this court is not inclined to grant bail to the present applicant and the same is accordingly rejected.
