Present applicant is seeking regular bail in relation to Case Crime No. 0048 of 2023 registered on the basis of FIR dated 25.12.2023 Police Station – Kapkot, District – Bageshwar, wherein present applicant has been implicated for the offences punishable under Sections 8 / 20 NDPS Act. 4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated and the contraband, which is shown to be recovered from the applicant, is below commercial quantity and there is no proper compliance of Section 50 of the NDPS Act. 5. On the other side, learned AGA for the State has vehemently opposed the bail application. He submits that applicant has previous criminal history of two cases and in one case, he is convicted. 6. After hearing learned counsel for the parties and further taking into consideration that applicant has previous criminal history, this Court is of the view that applicant does not deserves for bail. 7.
