1. The petitioner has filed this petition seeking the following relief(s):-
“(i) That, the Hon'ble Court may kindly be pleased to call for entire record pertaining to the petitioner's case, in the interest of justice. (ii) That, the Hon'ble Court may kindly be pleased to quash/set-aside selection list published by respondent no. 1 and 2 and direction may be given to publish fair and fresh selection list after holding inquiry and if petitioner finds place in selection list then order of appointment may be given to petitioner, in the interest of justice. -2- (iii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.”
2. Mr. Sahu, the learned counsel appearing for the petitioner would submit that the candidates of the reserved category cannot be selected and appointed in the open category. He would further submit that in the appointment order dated 28.09.2018, the members of OBC, Scheduled Caste and Scheduled Tribe have been selected and appointed in open category. 3. On the other hand, Mr. Bajpayee, learned Panel Lawyer appearing for the State would oppose the submissions made by Mr. Sahu. 4. I have heard learned counsel appearing for the parties and perused the documents placed on the record. 5. The contention made by Mr. Sahu appears to be misconceived. In the open category, the candidate who secures higher marks shall be placed irrespective of his or her category. 6.
Taking into consideration the above-stated facts, I do not find any good ground to entertain this petition. Consequently, this petition fails and is hereby dismissed. No cost(s). Sd/-
