DASARI RAMAKOTESWAR RAO counsel for the Respondent/COmPlainant: 1.PUBLIC PROSECUTOR The Court made the following ORDER: This Crim'Inal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking regular bail, in Crime No.169 of 2024 of Rolugunta Police Station, Anakapalli district. 2. A case has been registered against the Petit'lOner herein and others for the offences punishable under Sections `l-`. / I 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic substances Act, 1985 (for short 'the NDPS Act'), 3. Case of the prosecution, in brief, is that, on 24.06.2023, at about 15.30 hours, on credible information, the Sub-Inspector Of Police, Rolugunta police station, along with his staff and mediators, rushed to the outskirts of pedapeta village and found Al and A2 in possession of 78 KGs of Ganja. They confessed that they bought the sal'd Ganja from A4 to sell the same tO A3, The contraband was seized under a cover of mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5, A perusal of the material on record goes to show that basing on the confessional statement of co-accused the name of the petitioner hereI'n Was Shown aS accused in the Present crI'me. Petl'tioner herein was arrested in connection with another crI'me On 28.06.2024. Thereafter, the petitioner was remanded to judicial custody in this crime on execution of PT warrant on 21,08-2024 and since then he is languishing in jail. Learned Assistant Public prosecutor submitted that entire investigation _r± , riZ_ - E= i= 3 1 has been completed and charge sheet could not be filed for Want Of inventory. 6. ln view of the aforesal-d facts and circumstances of the case, this court is in6Iined~to grant bail to the petitioner/A3 on the following conditions. i) The petitioner/A3 shall be released on bail on his executing a personal bond for Rs.1O,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned Metropolitan sessions Judge-cum- I Addl'tional District and sessions Judge-Gum-Special Judge for trial of offences under the NDPS Act, Visakhapatnam. ii) Op release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7.
