Hon'ble Avnish Saxena,J. 1.Sri Lok Nath Shukla, Advocate appears and submits that the accused/applicant has been falsely implicated in Case Crime No. 63 of 2024, under Section 2/3 Gangster Act, Police Station Bhongaon, District Mainpuri. 2. Learned counsel for the accused-applicant, contends that in gang-chart only one case has been shown against the accused- applicant in which he is on bail. The other 14 cases are shown in criminal history. It is submitted that in all the cases shown against him, the accused is on bail and has not been convicted in any of those cases. As such, he prays that the accused/applicant be enlarged on bail. 3. Learned A.G.A. has opposed the prayer for bail and submitted that there is no record to show that accused is on bail in all the cases shown against him. 4. This Court has taken into consideration the rival submissions made by learned counsel for the parties and perused the records which prima facie reveals that there is only one case shown in the gang-chart and in all the cases there is no conviction as per the record which is conceded by learned A.G.A. The applicant is in jail since 07.11.2023. 5. As such the bail application is allowed. 6. The accused/applicant-Vipin Pandey be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned.
