2. The petitioner has filed this petition seeking the following reliefs:-
“10.1) That the Hon'ble Court be pleased to direct the Respondent no. 1 to 3 to place all record connected with the matter for the perusal of the Hon'ble Court. 10.2) That the Hon'ble Court may be pleased to quash the impugned order dated 14.12.2021 (Annexure P-7) passed by Respondent No.2. 10.3) That such other relief's as the Hon'ble Court deems fit in the circumstances of the case be granted to the Petitioner.”

A complaint was made by the villagers of Gram Panchayat Barbaspur, Janpad Panchayat Lormi, before the Collector, District Mungeli, against the Sarpanch and Secretary of the said Gram Panchayat inter alia on the ground that, in the year 2016, under the Scheme of Pradhan Mantri Gramin Aawas, a total of 41 persons were found eligible for housing benefits. However, the benefit was extended to only 17 persons, and 24 houses were not constructed. An enquiry was conducted against the petitioner, who was the Secretary of the Gram Panchayat and a total recovery of Rs.9,60,000/- was assessed, of which the petitioner was held liable to pay Rs.4,80,000/-. The petitioner has challenged the order dated 14.12.2021 passed by the Chief Executive Officer/Respondent No.2 (Annexure-P/7).

Learned counsel for the respondents would submit that the order passed by the Chief Executive Officer, Zilla Panchayat, Mungeli, dated
3 14.12.2021, is appealable according to the Chhattisgarh Panchayat (Appeal and Revision) Rules, 1995. They would further contend that a due enquiry was conducted and the petitioner was afforded sufficient opportunity to be heard. Therefore, the petition deserves to be dismissed.
5. I have heard learned counsel for the respondents and perused the documents present on the record.
6. A perusal of the documents placed on the record would show that a complaint was made against the petitioner and the Sarpanch of the Gram Panchayat, Barbaspur. An enquiry was conducted by a three- member Committee, and a report was submitted on 21.12.2020, wherein the petitioner and the Sarpanch were found guilty. Subsequently, another enquiry was conducted on a representation of the petitioner himself by a six-member committee, and a report was submitted on 27.9.2021. In this report, too, the allegations against the petitioner and the Sarpanch were found proved. Consequently, the impugned order (Annexure-P/7) dated 14.12.2021 was passed by the Chief Executive Officer, Zilla Panchayat, Mungeli. They would contend that the petition deserves to be dismissed.
7. Considering the facts of the present case, including the enquiries conducted by the Committees and the findings therein, wherein the petitioner and the Sarpanch have been found guilty, no case is made
4 out for interference. Accordingly, this petition fails and is hereby dismissed. No cost(s).
8. However, the petitioner would be at liberty to avail of the remedy available under the law.
9. Interim order granted earlier is hereby vacated. Sd/-
