1. The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed seeking directions/orders in FIR No. 30619/2021, registered by the Petitioner at P.S. Prashant Vihar. 2. The Petitioner asserts that he is the registered owner of a motorbike bearing registration number DL8SCU3467, which was stolen on or around 25th October, 2021 from the parking area of District Court Complex, Rohini. Despite exhaustive efforts to trace the vehicle, the Petitioner was unable to locate the same, and lodged an FIR bearing No. 30619/2021 under Section 379 of the Indian Penal Code, 1860. 3. The Petitioner further states that on 07th January, 2025, he received a phone call from P.S. Mahendergar, Haryana, stating that his stolen vehicle had been traced, and was lying in the custody of the said police station. The Petitioner duly visited the police station and identified his motorbike. This is a digitally signed order. The Petitioner subsequently applied before the Court of Metropolitan Magistrate, North-West Delhi, Rohini, seeking directions to ascertain the status of the motorbike and to produce the same before the Court. In response to the said request, the State filed a report stating that as per the police records, the Prosecution did not have any information regarding the recovery of the subject vehicle. After receipt of the said report, the Court passed the following order:
“Report filed by IO. Copy be supplied. Perused. As per report, no vehicle in question is deposited in concerned PS of Mahender Garh as well as PS Prashant Vihar. In view of the same, the application stands disposed of as dismissed.”
5. At this juncture, Mr. Mukesh Kumar, APP for the State, apprises the Court that the Investigating Officer has now confirmed that there are outstanding challans to the tune of INR 23,500/- against the Petitioner’s motorbike. 7.
In light of the above development, the Petitioner is permitted to re- apply before the Trial Court for seeking appropriate orders, in accordance with law. 8.
