1. Heard Ms. Indrapreet Kaur Chhabra, learned counsel for the petitioners. Also heard Mr. Malay Jain, learned Panel Lawyer for respondent / State.
2. The petitioner has filed this petition praying for following relief:-
“I. That, the Hon'ble Court may kindly be pleased to allow the instant petition under section 528 of B.N.S.S. 2023 filed by the petitioners. II. That, Hon'ble Court may kindly be pleased to quash the F.I.R bearing No. 109/2025 registered on dated 04.04.2025 at police station City Kotwali Mungeli, Dist. Mungeli (Annexure P-1) filed under section 103(1), 238 & 191(2) BNS and 25& 27 of the Arms Act. III. That, Hon'ble Court may kindly be pleased to quash entire charge sheet bearing No.34/2024 filed on dated 09/06/2025 before learned Chief Judicial Magistrate, District Mungeli (C.G.) (Annexure P-1) under section 103(1), 238 & 191(2) BNS and 25& 27 of the Arms Act. IV. That, Hon'ble Court may kindly be pleased to quash impugned order dated 01/07/2025 (Annexure P-2) whereby the learned District and Session Court, Mungeli has taken cognizance of the impugned charge sheet and registered the impugned criminal proceeding as Session Trial No. 15/2025 against the petitioners. V. That, Hon'ble Court may kindly be pleased to quash the order dated 22/07/2025 (Annexure P-2) whereby the learned District and Session Court, Mungeli has put charges against the petitioners under section 103(1) read with 190, 115(2) & 190 of BNS. VI. That, the Hon'ble Court may kindly grant any other reliefs in favour of the petitioners, which the
3 Hon'ble Court deems fit & just in the facts and circumstances of the case, in the interest of justice.”

Learned counsel for the petitioners prays to withdraw the present petition in order to approach the trial Court concerned for moving discharge application at an appropriate stage.
4. In view of the same, as prayed by learned counsel for the petitioner, this petition is dismissed as withdrawn, with liberty to take recourse to law.
