[2025:RJ-JP:46907] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 14534/2025 Shahnil S/o Anil Sharma, Aged About 27 Years, R/o 1341, Behind Chandrashekhar Ki Bagichi, Nahri Ka Naka, Shastri Nagar, Jaipur, Rajathan. (At Present Accused Is Confined In Central Jail Jaipur) ----Petitioner Versus State of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Amit Malani For Respondent(s) : Ms. Manju Dave, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 20/11/2025 1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.74/2025 registered at Police Station Vidhayakpuri, Jaipur for offence under Sections 308(4), 308(5), 351(3) and 66 of BNS, 2023. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that allegation against the present petitioner is that a mobile phone has been recovered from his possession which was used in the incident of threatening to Deputy CM to murder him. He argued that the petitioner has not given any threatening call, it is main accused Vikram who phoned to the police as narrated in the FIR. He contended that co-accused Manish Parihar has been enlarged [2025:RJ-JP:46907] (2 of 2) [CRLMB-14534/2025] on bail by this Court on 14.07.2025 and other co-accused Waseem Khan, Junaid and Mohd. Ashraf have also been enlarged on bail on 13.05.2025. The case of the petitioner is on similar footing. He again submits that petitioner is behind the bar since 01.04.2025 and charge-sheet has been filed. The trial of the case may take considerable time and no further custodial interrogation is required, hence the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Shahnil S/o Anil Sharma, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
