Order on Board 13.08.2025
1. The applicant has preferred this Second Bail Application under Section 483 of B.N.S.S. for grant of regular bail, as he has been arrested in connection with Crime No.131/2025, registered at Police Station : Sakri District – Bilaspur (C.G) for the offence punishable under Section 34(2) & 59(A) of the C.G. Excise Act. 2. As per prosecution case, on 11-03-2025, the police of Police Station Sakri received an information from the informant and on the basis of said information, conducted a raid and seized 5.400 bulk liters of VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.08.13 18:38:45 +0530
country made liquor from the possession of present applicant, therefore crime has been registered and filed the charge sheet before the concerned Court. 3. The applicant submits that he is innocent and has been falsely implicated in the present case. This is his second bail application, and after rejection of the first, several material and important prosecution witnesses have been examined, none of whom have supported the prosecution’s case, as evident from the copies of their depositions filed herewith. The alleged liquor was not recovered from his exclusive possession but from an open place, and the seizure memo prepared by the police is false, intended only to implicate him. The applicant has been in jail since 11.03.2025, the charge-sheet has already been filed, and the trial is likely to take considerable time to conclude. He is a permanent resident of the address mentioned in the cause title and there is no likelihood of his absconding, therefore, he prays for releasing the applicant on regular bail. 4. On the other hand, learned State Counsel appearing for the State/non-applicant opposes the bail application and submits that in the present case charge-sheet has been filed before the competent Court.
She further submits that from the possession of the present applicant 5.400 bulk liters of country made liquor was seized and he is also having 2 criminal antecedents of the same nature which are pending him, therefore he is not entitled for grant of regular bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the nature and
gravity of the offence alleged against the applicant, and the fact that, in the present case, the charge-sheet has been filed before the competent Court, however, 5.400 bulk liters of country-made liquor were seized from the possession of the applicant, and he also has two criminal antecedents of the same nature pending against him, as such, no new ground has been raised, and further, keeping in view the seriousness of the allegations against the applicant, this Court is of the considered opinion that the second bail application of the applicant is liable to be rejected. 7. Accordingly, the second bail application of the applicant namely, Gurunanak Lahare, involved in Crime No.131/2025, registered at Police Station : Sakri District – Bilaspur (C.G) for the offence punishable under Section 34(2) & 59(A) of the C.G. Excise Act, is rejected. Sd/-
