2 Crl.A No.532 of 2025 The Court made the following
JUDGMENT :- (Per the Hon’ble Sri Justice K.Suresh Reddy) Questioning the judgment of acquittal, dated 28.04.2011 passed by the learned IV Additional District and Sessions Judge, Kurnool, in S.C.No.348 of 2008, against A.4 to A.11, the State has filed the present appeal under Section 378(3) & (1) of Cr.P.C.
2. Today, when the matter is taken up,
learned counsel for the respondents/accused submitted that by virtue of the said Judgment, the learned IV Additional District and Sessions Judge, Kurnool convicted A.1 to A.3, who filed Criminal Appeal No.611 of 2011 before the combined High Court. He further submits that questioning the acquittal passed by the learned Additional Sessions Judge, in so far as A.4 to A.11 are concerned, the defacto complainant filed Criminal Appeal No.659 of 2011. After hearing both sides, the combined High Court allowed Criminal Appeal No.611 of 2011 by judgment, dated 21.02.2018 and Criminal Appeal No.659 of 2011 was dismissed by the combined High Court by Judgment, dated 21.02.2018.
3. On the other hand, the learned Additional Public Prosecutor also confirms the said fact.
4. In view of the dismissal of the appeal filed by the defacto complainant vide Crl.A.No.659 of 2011, nothing survives in the present Criminal Appeal.
5. Accordingly, while recording the above submissions, the present Criminal Appeal is dismissed. Consequently, miscellaneous petitions, if any, pending shall stand closed.
