During pendency of the instant second appeal, both the parties have arrived at compromise. Having considered the compromise took place between the parties, this Court, vide order dated 22.10.2024, has relegated the partied before the courts below to get their compromise verified and, accordingly, issued a direction to the office to send the compromise application before the Civil Judge concerned. 2. In compliance of the order dated 22.10.2024 passed by this Court, Civil Judge (Senior Division), Muzaffar Nagar has submitted his verification report dated 20.12.2024 along with the compromise verification order dated 18.12.2024 which has been endorsed at the rear side of Pg no. 8 of the affidavit filed in support of the compromise application. Learned Civil Judge, in his verification order dated 18.12.2024, has observed that all the three plaintiffs-appellants, namely, Dilshad, Mohd. Irshad, Momin Ali sons of Maqsood and Sabir @ Guddu son of Fateh Mohammad alias Phattu (sole defendant-respondent) have appeared in person before the court below and their signatures/thumb impressions have been verified by their respective counsels. Contents of the compromise have been spelled out to the parties in open court, who have admitted the factum of the compromise. For ready reference order dated 08.12.2024 passed by the Civil Judge (Senior Division), Muzaffar Nagar is quoted herein below: "ससुलहननामना तस्ददीक 18.12.2024 मनाननदीय उच्च न्यनायनालय दनारना ददतदीय अपदील ससंख्यना 1335 सनन् 2016 मम मनाननदीय उच्च न्यनायनालय दनारना पनाररत आददेश ददननासंक 22.10.2024 कदे अनसुपनालन मम वनाददी ददलशनाद, इरशनाद एवसं ममोमदीन पसुत्रगण शदी मकससूद व सनादबिर उरर गसुडसू पसुत्र शदी रतदेह ममोहम्मद उरर रतसू मनाननदीय उच्च न्यनायनालय मम प्रस्तसुत ससुलहननामदे कमो तस्ददीक दकयदे जनानदे हदेतसु व्यदक्तिगत रूप सदे न्यनायनालय मम उपसस्स्थित आयदे। वनाददीगण ददलशनाद , इरशनाद एवसं ममोमदीन कदे आधनारकनारर कदे आधनार पर दशननाख्त ककी गयदी तस्थिना मनमोज कसु मनार शमनार एरवमोकदे ट रजजस्टटदेशन ससंख्यना यसू०पदी० 3132/90 दनारना न्यनायनालय मम वनाददीगण कदे हस्तनाक्षररों एवसं असंगसूठदे दनशनानदी कमो तस्ददीक दकयना गयना। प्रदतवनाददी सनादबिर उरर गसुडसू पसुत्र शदी रतदेह ममोहम्मद कदे आधनारकनारर कदे आधनार पर दशननाख्त ककी गयदी तस्थिना अब्दसुल समद एरवमोकदे ट रजजस्टटदेशन ससंख्यना 26330 सनन् 2023 दनारना न्यनायनालय मम प्रदतवनाददी कदे हस्तनाक्षररों एवसं असंगसूठदे दनशनानदी कमो तस्ददीक दकयना गयना। उभयपक्षरों कमो न्यनायनालय दनारना ससुलहननामना पढ़कर समझनायना गयना। उभयपक्षरों कदे दनारना उक्ति ससुलहननामदे कमो समझकर स्वदीकनार दकयना गयना।" 4. Learned counsel for the appellants has submitted that both the parties have arrived at compromise on their own volition without any duress and coercion. It is further submitted that in changed scenario, both the parties have settled their dispute amicably out of the Court and, at present, they have no grudges against each other. They wants to observe peace and tranquility in their life; therefore, instant appeal may be decided on the basis of the compromise which has been duly verified by the learned Civil Judge. 5. Learned counsel for the sole defendant-respondent has nodded the submissions as advanced by learned counsel for the appellants and contended that the factum of the compromise is admitted and the contesting defendant/respondent has no objection in case instant second appeal is decided in the terms and conditions of compromise took place between the parties. 6. In this conspectus, as above, instant second appeal is finally disposed of in terms of the compromise, as mentioned in the joint affidavit of the parties filed in support of the compromise application.
