Rev.Appl.No.70 of 2025 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 20.03.2025 CORAM: THE HONOURABLE MR.JUSTICE R.SUBRAMANIAN AND THE HONOURABLE MR.JUSTICE G.ARUL MURUGAN Reveiw Application No.70 of 2025 and C.M.P.No.6980 of 2025 1.The State of Tamil Nadu, Rep. by its Secretary, Department of Higher Education, Fort St.George, Chennai - 600 009. 2.The Director of Collegiate Education, College Road, Chennai - 600 006. 3.The Regional Joint Director of Collegiate Education, Chennai Region, Chennai - 600 015. ... Applicants Vs. The Principal and Secretary, St.Christopher's College of Education, Vepery, Chennai - 600 007. ...Respondent Prayer: Review Application filed under Order 47 Rule 1 & 2 of CPC r/w. Section 114 of C.P.C., against the order dated 03.03.2025 made in W.A.No.574 of 2025. 1/5 https://www.mhc.tn.gov.in/judis Rev.Appl.No.70 of 2025 For Appellants : Mr.D.Ravichander Special Government Pleader For Respondent : Ms.Mary Sowmi Rexi for M/s.Isaac Chambers O R D E R (Order of the Court was made by R.SUBRAMANIAN, J.) We see no ground to review of the order passed imposing costs. The cost was imposed because we recorded a finding that the issue relating to approval of appointments is being re-agitated by the Education Department, despite the fact that it is decided by a judgment of a Division Bench of this Court which has been approved by the Hon'ble Supreme Court. We have also refused to sustain the view taken by the learned single Judge of this Court in M.V.Ekanathan Vs. the Government of Tamil Nadu made in W.P.(MD).Nos.2220 & 2221 of 2016 on the ground that it runs counter to the judgment of a Division Bench. 2. The contention of the Special Government Pleader is that it is because of the judgment in M.V.Ekanathan, the authorities were emboldened to file an appeal. The Authorities were parties to the judgment of the Division Bench of this Court in the State of Tamil Nadu Vs. the 2/5 https://www.mhc.tn.gov.in/judis Rev.Appl.No.70 of 2025 Secretary, Nirmala College for Women, which clearly lays down the law on the issue of approvals and on the issue of outsourcing of staff in Government aided Colleges run by minorities. Hence, we see no merit in the review. This Review Application, fails and it is accordingly, dismissed. No costs. Consequently, connected miscellaneous petition is closed. (R.S.M., J.)
