JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.1 under Section 483 of BNSS praying to grant bail in Crime No.169/2025 of Koramangala Police Station registered for the offence under Section 80(2) and 85 of BNS, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Heard learned counsel for petitioner and learned Additional SPP for respondent/State. 3. Learned counsel for petitioner would contend that the marriage of petitioner with the deceased was a love cum arranged marriage. There was no demand of dowry at the time of marriage and same is forthcoming in the averments of the complaint. The deceased became pregnant and there was abortion and deceased was under treatment for getting issues. The deceased was not happy with the marriage and she was of sensitive mind. Even the - 3 - HC-KAR NC: 2025:KHC:44428 CRL.P No. 13977 of 2025 death note does not contain any allegation against this petitioner of demanding dowry and harassing her. Charge sheet is filed and petitioner is not required for custodial interrogation. With these he prayed to allow the petition. 4. Per contra, learned Addl.SPP would contend that deceased has left death note. The statement of the land lady indicates that deceased was not happy with the marriage and her husband used to tell her to go and die. The said aspect itself indicates that there was abatement by the petitioner to the deceased to commit suicide. The charge sheet material show prima-facie case against the petitioner for offences alleged against him. With these she prayed for dismissal of the petition. 5. Having heard the learned counsels, this Court has perused the charge sheet and other materials placed on record. 6. The marriage of the petitioner with the deceased has taken place on 23.11.2023. The petitioner and the - 4 - HC-KAR NC: 2025:KHC:44428 CRL.P No. 13977 of 2025 deceased were residing in a rented premises at first floor, 4th Cross, 17th Main road, 4th Block of Koramangala i.e., the house of CW.13. The deceased committed suicide between 19.02.2025 to 21.06.2025 by hanging herself. The petitioner was not in the house during that period. The death note does not indicate any demand of dowry and harassment by the petitioner to the deceased. There was no any complaint by the deceased against the petitioner prior to she committing suicide. Mainly because the petitioner asking the deceased to go and die does not amount to abatement. As the charge sheet is filed petitioner is not required for custodial interrogation. The petitioner is ready to abide by any terms and conditions to be imposed by this Court. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. Petitioner is granted bail in Crime No.169/2025 of Koramangala Police Station, subject to the following conditions: (i) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the like- sum to the satisfaction of jurisdictional Court. (ii) Petitioner shall not tamper the prosecution witnesses either directly or indirectly. (iii) Petitioner shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
