This is the Second bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 310/2023 registered at Police Station – Bilaigarh, District Sarangarh-Bilaigarh (C.G.), for the offence punishable under Sections 20(b) of the NDPS Act. 2. The earlier bail application filed under Section 439 of the Cr.P.C. in MCRC No. 8952 of 2023 for grant of regular bail to the applicant, which was rejected vide order dated 11.01.2024. 3. 2 Ganja inside a red-coloured car bearing Registration No. CG-07-LG- 5555 for sale, the police authorities conducted a search and seized a total of 39 kg of cannabis (Ganja) from the possession of the present applicant. Thereafter, the applicant was arrested, and a case was registered by the police. 4. Learned counsel for the applicant submits that the present applicant has been falsely implicated in the present matter. He submits that this Hon’ble Court had directed to complete the trial within a period of six months from the date of receipt of a certified copy vide order dated 11.01.2024, but till date, the learned trial Court has not concluded the trial even after lapse of considerable period. He further submits that the independent witnesses have already been examined and they have not supported the case of the prosecution and the present applicant has been in jail since 11.01.2024, therefore, he prays for grant of regular bail to the present applicant. 5.
On the other hand, learned State counsel opposes the bail application of the present applicant and submits that quantity of contraband article i.e. total 39 Kgs of Ganja was recovered from the possession of the present applicant, which is much above the commercial quantity and as such, the applicant is not entitled to be released on bail. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. From perusal of the case diary, it transpires that the contraband article which has been seized from the possession of the present applicant is much above the commercial quantity and it cannot be a case of false implication, the trial is in progress. 8. Accordingly, the Second bail application of the applicant –

However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial as expeditiously as possible within a period of three months from the receipt of a certified copy of this order in accordance with law, if there is no legal impediment. 10. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
