1. Petitioner has filed this petition assailing the resolution dated 03.08.2017 and 24.08.2017 passed by the Gram Sabha and Gram Panchayat, Chhuipali respectively whereby a resolution has been passed to construct a business complex on Khasra Nos. 565/2 and 565/3 ad-measuring 0.360 and 0.100 hectare respectively although the land does not belong to the Gram Panchayat.
2. Evidently, the resolution passed by the Gram Sabha and Gram Panchayat, Chhuipali is appealable according to the provisions of Rule 3 of the Chhattisgarh Panchayats (Appeal and Revision) Rules, 1995 therefore, instant petition is not maintainable.
3. Consequently, this petition being not maintainable stands dismissed. However, petitioner will be at liberty to take recourse to law. Certified copy be returned after retaining its xerox copy. Sd/- (Rakesh Mohan Pandey) JUDGE Ajinkya
