Order 14/02/2025
1. This 3rd bail application has been filed by the petitioner under Section 483 B.N.S.S. in connection with FIR No. 159/2021 registered at Police Station Shrinagar, District Ajmer for the offence(s) under Sections 143, 323, 341 and 302 IPC (late on offence under Sections 147, 148, 149, 323, 341 and 302 IPC were found to have been made out).
2.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since 16.11.2021. Charge sheet has been filed against the petitioner. Conclusion of trial may take long time. So, petitioner be enlarged on bail.
3. Learned Additional Government Advocate as well as learned counsel for the complainant have opposed the 3rd bail application
[2025:RJ-JP:6671] (2 of 2) [CRLMB-906/2025] and submitted that petitioner and other co-accused had inflicted injury on the head of Pawan Yadav and deceased died on account of head injury. Learned Additional Advocate General also submitted that trial is going to be concluded very soon because statement of Investigating Officer has also been recorded by the trial Court. So, looking to gravity of offence, 3rd bail application filed by the petitioner be dismissed.
4. I have considered the arguments advanced by the learned counsel for the petitioner as well as learned counsel for the complainant and learned Additional Government Advocate.
5. As per the statement of the witnesses and CCTV footage petitioner and other co-accused had inflicted injuries to the deceased Pawan Yadav. As per postmortem report, deceased had multiple fractures and multiple contusion on right fronto temporo parietal region. Deceased-Pawan Yadav died due to head injury. So, looking to the nature of allegations and gravity of offence, I do not consider it a fit case to enlarge the petitioner on bail.
6. Hence, the 3rd bail application filed by the petitioner stands dismissed.
