Date of decision: 24.07.2025
Anubhav Khanna
….Appellant.
Versus Punjab Cricket Association and others ....Respondents.
CORAM: HON’BLE MR. JUSTICE SHEEL NAGU, CHIEF JUSTICE HON’BLE MR. JUSTICE SANJIV BERRY, JUDGE Present:- Appellant in person (through video conferencing). ..… SHEEL NAGU, CHIEF JUSTICE (Oral) This intra Court appeal has been preferred assailing the
order dated 28.02.2025 passed by learned Single Judge while exercising the writ as well as supervisory jurisdiction under Article 226/227 of the Constitution of India.
2. Challenge before the writ Court, as contended by the appellant/petitioner, who appears in person through video conferencing, was to the membership of respondent No. 3 in the Apex Council of Punjab Cricket Association (PCA). For this purpose a writ of quo warranto was sought.
3. The appellant/petitioner failed to establish before the learned Single Bench that respondent No. 3 was holding a public office. Learned Single Judge has also found that certain material facts have been suppressed in the writ petition. As regards the relationship, respondent No. 3 is the brother-in-law of the appellant/petitioner and the sister of respondent No. 3, who is the wife of appellant/petitioner, had lodged an FIR No. 120 dated 15.07.2021 against the appellant/petitioner and his parents, at Police Station City Fazilka, under the provisions of Indian Penal Code and Dowry Prohibition Act. 4. During the course of arguments before the learned Single Judge when this factum of suppression came to light and the Court asked, as to why the said material facts have been suppressed, the appellant/petitioner contended that it was a mistake.
5. Even today before this Court, the appellant/petitioner is unable to establish that the office held by respondent No. 3, is a public office and the explanation given, as regards the objection of the learned Single Judge, in respect of suppression of material facts, does not impress this Court.
6. In view of above, this Court finds no cause to interfere with the well-reasoned order passed by the learned Single Judge dated
28.02.2025. Accordingly, this appeal stands dismissed with cost of Rs. 50,000/-, to be deposited with the Punjab and Haryana High Court Bar, Association Lawyer’s Family Welfare Fund. The cost be deposited within a period of 15 days.
