CORAM: HON'BLE MR. JUSTICE NAVIN CHAWLA HON'BLE MR. JUSTICE SAURABH BANERJEE O R D E R % 28.03.2025 REVIEW PET. 187/2025 1. This review petition has been filed by the respondent in the captioned appeal (hereinafter referred to as the ‘father’), seeking review of the Order dated 18.02.2025 passed by a bench of which one of us (Hon’ble Mr. Justice Saurabh Banerjee) was a part, wherein, it had, inter alia, been recorded and directed as under: “2. After some arguments, learned counsel for the parties agree that the impugned order be modified by directing that the appellant will drop the minor children at the official accommodation of the respondent at 11:00 AM, on every alternate Sunday i.e. 1st and 3rd Sunday of the month, whereafter the respondent will drop back the children to the residence of the appellant at 04:30 PM on the same day. 3. Needless to state that it will be open for the parties to seek modification of this This is a digitally signed order. The learned counsel for the father submits that the father had never consented to the modification of the visitation rights of the father over the minor children granted by the learned Family Court, and that his consent has been wrongly recorded in the Order dated 18.02.2025. 3. We note that the Order dated 18.02.2025 was passed in Open Court. Therefore, in case the counsel for the father had any objection to the recording of his consent regarding the modification of the visitation, he should have got his objection recorded then and there itself. He, in fact, waited for almost more than a month to file this Review Petition, probably waiting for one of the learned Judges, who was part of the Bench, to retire, and for the memory of the Judges to fade. We do not appreciate such sharp tactics. 4. The review petition is accordingly, dismissed. NAVIN CHAWLA, J SAURABH BANERJEE, J MARCH 28, 2025/sg/VS This is a digitally signed order.
