Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 25-03-2025 1) By way of this petition, petitioner has sought following relief(s):- 10.1 That, this Hon’ble Court may kindly be pleased to allow the writ petition and direction to the respondent concern that decided the representation of the petitioner. 10.2 That, this Hon’ble Court may kindly be pleased to direct to the respondent No. 2 i.e. Collector Jashpur to acquired the land and compensate the same and thereafter stated the construction of the Road. 10.3 That, the amount of the remaining unlevelled land should be awarded or given Digitally signed by AJINKYA PANSARE Date: 2025.03.25 17:27:24 +0530 direction to the concern authority to level it up to the height of the new constructed road. 10.4 That, this Hon’ble Court may kindly be pleased to call for the entire records relating to the matter. 10.5 Any other relief/reliefs which may deem fit and proper in the facts and circumstances of the case may also be allowed. 2) Facts of the present case are that the part of lands of petitioner situated over Khasra Nos. 441/4, 41, 45, 47/2, 67/5, 32, 179 and 337/2 total ad- measuring 5.40 acre situated over Village-Bansbahar, Teh.- Kansabel, District- Jashpur (C.G.) were used for construction of road without acquisition of land. 3) Petitioner has made a prayer in this petition that Collector, Jashpur may be directed to initiate a land acquisition proceeding and make payment of compensation and also decide the pending representation of the petitioner. 4) Learned State counsel submits that representation dated 16.12.2020 moved by the petitioner is pending consideration and the authority concerned would decide it expeditiously strictly in accordance with law. 5) Heard. 6) Taking into consideration the limited prayer made in the petition, instant petition is hereby disposed of directing Collector, Jashpur i.e. respondent No. 2 to decide the pending representation dated 16.12.2020 so moved by the petitioner in accordance with law, preferably within period of 150 days from today. 7) Accordingly, instant writ petition stands disposed of at admission stage.
