ORAL ORDER
This petition is filed by accused No.1 under Section 482 of Bharatiya Nyaya Suraksha Sanhitha, 2023 praying to grant anticipatory bail in Crime No.49/2024 Jayanagara Police Station, Shivamogga, registered for the offences punishable under Section 109, 196, 198, 420, 34 of IPC and Section 5(A)(b) of Karnataka Scheduled Caste and

Scheduled Tribe and other backward classes (Reservation of Appointment) Act, 1990.
2. Heard the learned counsel for the petitioner and learned High Court government Pleader for the respondent No.1/State.
3. The learned counsel for the petitioner would contend that, the Caste certificate issued to the petitioner has been cancelled by the Tahsildar in a proceedings by
order dated 29.05.2024 and based on the same, complaint has been filed against the petitioner and others. The petitioner has not obtained any employment by virtue of the said caste certificate. The petitioner is ready to co- operate with the police in the investigation and abide any conditions to be imposed by this Court.. With this, he prayed to allow petition.
4. Per contra, the learned High Court Government Pleader would contend that the petitioner, inspite of issue

of notice has not appeared before the Investigating Officer for investigation. With this, he prays to reject the petition.
5. Having heard the learned counsel, the Court has perused the FIR, complaint and other materials placed on record.
6. The accusation against this petitioner is that he giving false information got issued the caste certificate and committed offences alleged against him. Offences alleged against the petitioner are not punishable either with the death or imprisonment for life. There are no criminal antecedents of the petitioner. The petitioner is ready to co-operate with the Investigating Officer in the investigation and abide by any conditions to be imposed by this Court.
7. Considering the above aspects, the petitioner has made out a case for grant of anticipatory bail with conditions.

In the result, the following:
ORDER
i) The petition is allowed.
ii) The petitioner is ordered to be released on bail in the event of his arrest in Crime No.49/2024 of Jayanagar Police Station, Shivamogga, subject to following conditions:
a) The petitioner shall voluntarily appear before the Investigating Officer within fifteen days from this day, and execute a bail bond for Rs.1,00,000/- (Rupees one lakh only) with one surety for the like sum to the satisfaction of the Investigating Officer.
b) The petitioner shall co-operate with the Investigating Officer in the investigation
c) The petitioner shall appear before Investigating Officer whenver called for.
d) The petitioner shall not directly or indirectly make an inducement, threat or promise to any

person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
