The present writ petition has been filed by the petitioners with the following relief(s) : 2 “i) That, the Hon’ble Court may kindly be pleased to call for the entire records of the case. ii)That, the Hon'ble court may kindly be pleased to issue a directing the respondents suitable immediately taken decision with respect of inquiry report made by the respondent no. 4 in pursuance of the complaint made by the petitioner and also directed to passed the dismissal order against the Employment Assistant (Rojgar Sahayak) of Village Panchayat Semra Tahsil Ratanpur Janpad Panchayat Kota District Bilaspur (C.G.). iii) That, the Hon'ble court may kindly be pleased to issue a suitable writ for directing the respondents to immediately lodged the first information report against the Employment Assistant (Rojgar Sahayak) of Village Panchayat Semra Tahsil Ratanpur Janpad Panchayat Kota District Bilaspur (C.G.) on the basis of inquiry report conducted by the respondent no. 4. iv) Cost of the petition may also be granted to the petitioner. v) That, any other relief, which the petitioners are entitled and this Hon'ble court deems it fit may kindly, be granted to the petitioners.” 2. Learned counsel appearing for the petitioner submits that the petitioner is not challenging against any particular order but he is seeking suitable direction by this Court by which respondent authority have not taken any decision against Employment Assistant (Rojgar Sahayak) of Village Panchayat Semra Tahsil Ratanpur District Bilaspur (C.G.) and also, not been removed/dismissed from his service, who is committed fraud in Government Scheme Pradhan Mantri Awas Yojna, (Prime Minister Housing Scheme) which dully proved by respondent themselves after conducting the inquiry, But the decision taken against 3 the rojgar sahayak (Employment Assistant) has been made against the inaction and illegal action of the respondents. 3. Learned State counsel opposes the submission made by counsel for the petitioner and contended that the petitioner has no locus standi to file the petition. 4. I have heard learned counsel for the parties and perused the documents with utmost circumspection. 5. Considering the facts and circumstances of the case and submission made by learned counsel for the parties. Further considering the fact that on being complaint made by the petitioner, inquiry has already been initiated by the concerned authority against the concerned Employment Assistant (Rojgar Sahayak). On perusal of the present petition, it transpires that the present petition is drafted with the defective one, therefore, I am not inclined to entertain the present petition with such a vague and sketchy prayer as in the present petition the concerned Employment Assistant (Rojgar Sahayak) has not been made a respondent party in the present petition, therefore, this petition is not maintainable. 6. Accordingly, the petition being devoid of any merit is liable to be and is hereby dismissed. Sd/- (Arvind Kumar Verma) Judge Vasant
