This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending her arrest in connection with Crime No.108/2025 GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.08.26 16:41:07 +0530 2 registered at Police Station – Patna, District- Koriya (C.G.) for the offences punishable under Sections 420, 506 and 34 of Indian Penal Code. 2. Case of the prosecution, in brief, is that Shamshad Ansari obtained a total of 17 lakhs by deceiving the complainant by investing money in trading and promising to return the money double in 72 days. After completion of this period 72 days, when the complainant asked for money back, Shamshad Ansari did not return the money back, when the complainant asked for money, a shooter was called from Uttar Pradesh and he was threatened to be killed. It is alleged that against the applicant Gulsan Praveen that out of said amount of the 17 lakhs, 5 lakhs were transferred on 11.03.2024 through RTGS to the account no 5386607768 of the applicant Gulshan Praveen in central Bank of India branch Pandavpara. 3. Learned counsel for the applicant submits that the applicant is innocent and she has been falsely implicated in the instant case and the allegation against the applicant is that complainant Belal Mohammad transferred Rs. 5,00,000/- through RTGS on 11.03.2024 to the account of the applicant in Central Bank of India under trading business of the applicant's husband Shamshad Ansari and son-in-law Irfan Khan, whereas the applicant herself has no knowledge about the amount transferred and no conversation with complainant regarding the transfer of money. He would submit that applicant is a housewife and she has no criminal antecedents, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 3 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail and he would submit that the applicant has no criminal antecedents. 5. Learned counsel for the objector also opposes the prayer for grant of anticipatory bail. 6. I have heard learned counsel for the parties and perused the material available on record. 7. Considering the facts & circumstances of the case, submissions of learned counsel for the parties, material available on record, considering the nature of allegation levelled against the applicant and also considering the fact that the applicant has no criminal antecedents, therefore, I am inclined to grant anticipatory bail to the present applicant. 8. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Gulshan Parveen, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. 4 (c) The applicant shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
